They are not giving any warranty regarding prior clouds or claims, so a good title search and owner's title insurance are critical.In Massachusetts (my home state), I've never seen anything buy a quitclaim deed.With a warranty deed, the seller is giving you a warranty against previous clouds or claims.

My guess is that this wasn't the first time they were late on rent and the landlord let his frustration cloud his/her judgement.Also, you may not have the entire story.

If that is the case all title policies will have that cloud, so if your lender is requiring clean title, which makes sense, then you will probably be unable to get a mortgage.

There are ways to monetize the ITC on investment property such as using a 3rd party that can take the tax credit and pass the savings on, like in a PPA or lease situation, but those options have some drawbacks such as clouding the title with a UCC-1 fixture filing (kind of like a lien) which isn't a benefit during transfer of title as in during a sale.
