Was the title company able to gather documents from the seller, or were they never contacted?

When someone is a buyer on a contract they have equitable title, which means they have an interest in the property (in VA).

We signed a JV agreement afterwards showing 50/50, but names were not added to title until we changed to the LLC ownership.

When you refinance for a lower rate, you'll need to pay all of your closing fees again (title, escrow, insurance, origination fees, processing fees, etc).

It does not always make sense to have the note recorded on title as it can cause other complications down the road, but that also means much less protection for the lender so it really depends on the circumstances.
