From just the picture I would even them out, fill the gaps with wood filler and use a gel stain that is closest to matching.You can pound the staples in and just use wood filler to cover the hammer marks if you use a darker gel stain.

If something changes with the property you can still buy under the same contract conditions, try and re-negotiate those conditions and price, or the seller can tell you to go pound sand and they will do nothing and put it back on the market.What options are available and specific performance if any rests with the language of the contract signed and agreed to by the parties.
