Since the error is "customer placed stop payment," I'm guessing this is worst case scenario and he purposefully chose to stop the payment.Yes, the lease specifies serving a cure or quit notice if not paid 5 days after due date.

I'd say it's more than fair to remit back their entire deposit and go your separate ways.My concern is that you knew about the smoking and the dog long ago but you used that as the basis for the cure or quit notice.

Most importantly, you'll need the owner to provide a written intent to cure to the county trustee and get them to make a request of the lien holder to stop the proceedings at least 15 days prior to the sale.

===============In these high crime areas you might want to think about:Cutting all shrubby back to tiny to prevent places for Rapists to hide.Having security or maintenance Inventory all lighting nightly after dark to make sure it has not been tampered with (re bulbs unscrewed etc.. more Rape prevention).Have all move out verbally questioned as to why they are moving out, have PM note any hot spots on the property (or reasons) for move outs (cure them imminently).I highlight this Rape issue because sometimes the lades get away and don't report it anyone, but their neighbors (and sometimes management).....And one scared Rabbit moving out because of this, can make a lot of other units in the complex with females empty out too.
