And even if the due on sale wasn't enforced you would be dependent on them making payments to the bank.

And I honestly can't blame the government because if you look at this situation he did exploit the lack of regulation and enforcement.

Does anyone have any idea if this would be worth going to court over and if it is and I get the judgement I want is it enforceable? 

Be aware you will start getting requests from law enforcement and neighbors to view videos.

You assume the owner occupant term is not enforceable...what are the legal grounds for that?

I have absolutely no intention of signing this document though know they will have some recourse to enforce the easement if need be.
