Good Afternoon Everyone,              I am going to use my parents as a portfolio lender and I was wondering when I use thier 401K to execute the aquistion of a property what will the tax implications be when using the 401K and can I use a 1031?

If not, I'm not sure you have any legal standing as you have not given any "consideration" to execute the contract you signed.I would make sure that your binder contract has an approximate move-in date, or time period after which either party can walk away if the unit is not ready.  

All current owners would have to be in agreement to execute.

On page 3 of the application form, under FEES, the box 1 is checked which states '$50 to be applied to the security deposit upon execution of a lease or returned to Applicant if a lease is not executed'.

Back it up by supplying them with all of the numbers, and a concrete plan of how you're going to execute the work and earn them a return on their money. 

If your plan of flipping homes leads you to your "Critical Mass" point, then by all means execute on your vision vigorously.

Did you sign a purchase/sell contract with your buyer for a Selling Price higher than what you have it under contract for OR did you execute an Assignment agreement with your buyer where he takes over the purchase agreement Directly with your seller and also pays you a fee of $5k or so?

EZ to read sometime difficult to execute.
