regardless of breach of contract the fact remains the damage is done.Does this lady have any equity or did she just let the guy take titel sub too and got her equity as a down payment do you know that ?

I met with the gentleman yesterday who is the son of the deceased lady and he is indeed the executor. 

There was a lady on BP here who had this very thing happen to her, and I know of other people (not landlords) who tried to save a couple of bucks that way only to have a lien slapped on their house, and when they tried to claim paying the contractor in cash they showed records that they never take cash for payment, and it's one word against the other.
