Since you haven't received the funds yet, you cannot claim any loss for 2024.If you receive the 10% return of principal in 2025 and the investment is officially terminated or sold at that time, you could potentially claim a capital loss for the remaining 90% on your 2025 taxes.

Of more concern to me would be the ridiculous investment strategy; the qualification of the sponsors to evaluate these brand investments; whether proper and full disclosure was provided; and the fees and other compensation the sponsor received on invested capital.

Not sure about CO, but we make tenants sign a NON-Refundable Holding Fee (not Deposit) Agreement for any monies received prior to move-in to HOLD the home for them.

Essentially a donation with a multiple on it - so high level, 'donate' $50k, receive a $250k reduction in AGI.

I received about 60k of available credit in less than 30 days. (16k within the first week).

That pushes cash on cash from down payment about 5.5 to 6% starting out and with mortgage paydown about 10% total return annually before rental increases.

Many returned near 20% annualized returns.
