DR Horton for example does have some currently pending around the $305k range, but they are quite a bit smaller (1200-1300 sq ft).

I still owe 162k, house value is approximately 280-300 but the quote given to me has 305 as estimated value (pending appraisal), but i feel like 15k closing cost is toooo much.... any input will be appreciated. thanks!

Although almost all the units are pending, they haven't been sold so the only loan that is available is an 7 year ARM @ 5.25% that I would then have to refinance and convert to a 30 year after 1/2 the units have been sold.

The best course of action, if you can manage it, is to tie up the property so he cannot sell it pending the resolution of the dispute.
