Now house is done and you worked with an Agent or a Prop manager to get a tenant and you have a lease in place and have collected security deposit. 

Let them get a judgement and try collecting on it..ambulance chasing lawyers...forget it.

I don't believe that you can get a specific contingency on vacant space for CRE, but typical due diligence is 60-90 days with 1 or multiple 30 day extensions. 

If it's just about getting the inspection report back and you need more time, ask for an extension on the contract. 

For booking extensions, if you have a lease in place, you should follow it's terms.

For example, collecting three months of rent upfront helped you avoid missed rent, but even that could have backfired if they missed more than three payments.
