Most leases will contain something like this:If Lessee fails to pay Rent, or otherwise Defaults under this Lease, Lessor may use, apply or retain all or any portion of said Security Deposit for the payment of any amount due Lessor or to reimburse or compensate Lessor for any liability, expense, loss or damage which Lessor may suffer or incur by reason thereof.I would not expect to give it back in this case, because essentially they have broken the agreement, but again it depends on the language of the lease you've had them signed whether they are "entitled" to it or not.

The Amendment should include the additional security deposit amount and language requiring that the additional occupant be added to the renters insurance policy (must have updated insurance declaration before additional tenant moves in).

The PA may have language that deals with this too, but w/o seeing it, can't say.As for the EMD, if the sellers agent wanted to enforce that, they should have done so according to the contract.

"As is" language is fairly common and with it, don't expect the seller to complete repairs/improvements upon the property.

I also believe property owners can add to their application something along the lines of: "Do you currently have or plan to have an animal that will be living with you" and because the language uses "animal" and not "pet", the applicant must respond yes if they have an ESA.

The E&O carriers have suffered significate losses as a result of theses Business Email Compromise frauds (BEC) as the FBI calls them and so have changed the language of the policies to exclude the loss except for the rider.
