page=1#axzz2rQTi3H9wI've followed other cases, too, and most all seem to be related to blatant, over-aggressive and wholesale application of this law.For the living, this is a painful situation to be caught up in.The major takeaway is that A.P. is a tool of last resort, not an objective to search for scenarios to apply this law (which is available in all 50 states).

You never know how the sheets will be split between parting partners.Avoid potential issues, hold all major players responsible, enforce terms jointly and severally, take the position to collect amounts due from the most economical path in a timely manner.It's prudent lending practice, failing to do so is poor management identified by regulators for insured institutional lenders if major players are not held responsible.

Here in the east you will see both, but there is a preference for Power of Sale by the institutional lenders.Here you will see small multifamily (1-6) come up as bank owned, but not the mid-sized to larger buildings - as you indicated, they usually have someone in second and/or will be sold off - often to a big player such as Killam or Brookfield - before going down the path of foreclosure.

I think we have to determine this before we can attempt to understand the new concept of "Institutional Crowdfunding".It sounds like Institutional Crowdfunding of Loans is just a new name for the same old players but may now include Hedge Fund Operators that have made themselves "accredited" and without "accreditation" you can not participate in buying into your slice of the Institutional Lending Pie?
