This is a bit tongue in cheek, but a title policy is more accurately described as a settlement agreement in advance in which the title insurer attempts to specifically define and limit their obligations in connection with any negligence they commit in their title search.

Some of my extended family members have had that surgery and it's very rare to not have complications and the shoulder back to what it was before you started having issues.It's one of those surgeries that in many cases produces negligible to marginal results.

I have something similar in my lease agreement and an addendum that the tenant sign which outlines "negligence" in regards to the plumbing issues and damages outside of normal wear & tear.

Best you see a finance attorney, not a real estate attorney unless they have studied this Act through appropriate training.And yes, I'm sure there is going t be an increase in the "predatory lending" arena by attorneys, fines and judgments can be higher than negligent death case and no one gets killed in financing, they may with they had when it's all over with. :)

That being said the case could be made that it was the tenants negligence to correctly close the door resulting in the damage.Now personally I'd pay for the window and let the tenant leave.

Unless you didn't secure the fire escape or you left a ladder there I don't see you being negligent for their stupidity or training session, LOL. :)
