Most tenants don't do a great job taking care of it and you will have to constantly replace it due to things like coffee/food/wine stains, tracking in dirt, pets, etc.

lots of facts missing but oral contracts are upheld in court. also, unclear if the partner is a partner in the wine business or the land. this is not legal advice, however, if owner wants a second opinion happy to give a proper consultation.
