There's really not enough info here for a direct answer, BUT lenders counting income from rentals is an overlay, not a regulation.

I'm just more concerned about tenant/landlord laws.What I am really trying to figure out is if he does leave on the 29th but never gave the keys over, can I still legally enter and change the locks or does this not count as legally getting possession back of the house because he never gave the keys?

I would caution someone not to count on the high rents though; it is great while it lasts but when analyzing be sure to use non-O&G rents.

A sub to deal does severely limit the seller's ability to purchase a new home as it does leave the debt in the DTI for some time and is not counted only if the above conditions are met.
