I'm not seeing an intentional preditory path so much as poor lending practices, advice and professional negligence perhaps that has resulted in your position.I suggest you get all of your documents, written notes of conversations, financial statements during the periods and copies of appraisals together and see a qualified attorney.And again, don't play like you don't understand but rather that you were led through the process as a requirement by your bank to restructure your loans.

Ultimately, as long as you are well insured and are not negligent, you should be fine with either route.As an IL resident I personally prefer the LLC route because it makes me feel better and I use the Series LLC frequently.
