I'm very picky about renters and will probably show the apt. a significant number of times, unless I get lucky, and while reasonable notice is not an issue, I like to be very polite to both tenants and owners (which is why I put the time frame in there) , I don't want to be hindered by them not being available.

On deals i have been in with parks, there have been seller financed notes, park owned homes, skid steers, laundromats, apartments , houses etc, cars, vending, etc and as long as the rest of the deal pencils out , you just try and figure out a way to make it work with both parties being ok and it not being a significant hinderance on the transaction.

To answer your question, the fraudulent conveyance theory is based on the general rule that, speaking very broadly, in many states transfers by a debtor while insolvent in order to "hinder, delay, or defraud" creditors are subject to being set aside.

I am not sure how such a loan would not be enforceable but these stupid laws passed that were supposedly intended to protect consumers, do very little of that and mostly hinder commerce.Just my opinion.So, your best advice in this scenario is to ask the current note holder (the note originator) to re-do the loan with the borrower and then sell to me?
