I don’t know your location however where I am outside of negligence from an unsafe tree if one falls each neighbor is responsible for the part that is in their yard.

If this proves not to be the case, you may be able to pursue a negligent misrepresentation theory against the seller (a claim typically covered by insurance).

It's notoriously difficult to sue an inspector for negligence, so I don't think that's in the cards for you.Beyond that, unless you can prove it was known to the seller at the time of sale, I don't see how you get any liability for failure to warn/disclose.

If you don't draw down on it, you aren't paying for it (some banks do have a $50 or $100 fee per year to keep it open, but that's negligible).
