Without seeing the leases or your management agreement no one can advise the best route. 

Knowing that this can trigger due on sale, would it still be advisable to the the Wrap?  

My advise is to determine how much you can make on charging 10% on single family and four plexes, 6% on 5-49 units and 8% PM for older properties that will need a lot of repairs. 

Call your agent and ask.The court will ask them what their monetary loss is.

It was our fault so it is what it is, but it sucks that an honest mistake that would have been a super tiny inconvenience for the guest ended up being a huge thing for us with a monetary fine and likely lots of money lost in future reservations.  

It's advised to keep cash in reserves for vacancy and maintenance so 70% down payment might give you enough cash flow and you have some reserves.
