We missed a few great deals in 2022/2023 because we has an escalation clause that was nearsighted.

Sounds like you have a nice cash flowing property already and see a tremendous opportunity with a new property.

I have a lot of respect for Marco as I find him to be extremely thoughtful, intelligent and a tremendous resource for Real Estate Investing and investing in general.  

If you go to court, there's some cost to that and you'd be risking more escalation if they sought counsel as well.My approach for problem tenants is just appease them if the cost is minor and then not renew the lease, or even cash-for-keys if necessary.

A master lease to the organization structured with an annual escalation clause and a term limit - like up to 5 years - was a recommended way to get a contract. 

It worked tremendously and I was on pace to pay off my 240k 30 year mortgage in 9 years not changing anything other than the way I held money.

Add some escalator, such as 3%, for example, to account for potentially higher costs after closing.
