@Brian Tschida If you set up your LLC in CA it will be considered a "foreign entity" here in Texas.

For foreign contractors do you withhold tax of their pay?

If we hire a Non US VA, I am supposed to withhold 30% of the pay for tax reporting. The contractor wants to use his uncle's construction company LLC located in US to be the contractor and he becomes the subcontractor ...

(I don't use the foreign tax exclusion because I invest in a ROTH IRA and they won't allow that.)Not sure if anyone would have some advice for us. or would be able to help us work with us on this but my wife and I together earn between 60 to 80 thousand a year in USD of course it can vary on the exchange rate.
