Personally as part of my lease for condos I state that any HOA fee incurred due to a tenant's actions or neglect will be passed on to them and due to me within 30 days.

The other markets might be as well, but what I know about my market is we saw 2% appreciation throughout our mls last year despite the national news of real estate being in a decline… we are so insulated from the “bubble” conversation.

However, the possibility the former owner or one of the lenders will claim service was improper is one of the reasons title insurers are reluctant to allow a policy to be issued w/o a quit title action being completed first.It's a good idea to ask the title agent for a commitment that will show the requirements for the issuance of a policy w/o exception for other interests.
