The property will be returning back to me because it is a collateral, i'm in a bad position as the property can no longer be livable now and the value is obviously lower.

A seller financed note and deed of trust can go the non-judicial route.The issue with installment sales, contract for deeds especially, is that any pre-arranged agreement to secure collateral violates foreclosure laws, circumventing the law set to protect an owner's equity.

You may be able to use the cash as collateral for a loan if you want to retain it while the bankruptcy falls off or put in a brokerage account and buy some decent dividend paying stocks and pull out cash using the available SMA in the account effectively creating you own loan while the dividends cushion the interest your paying.
