Any delay will only complicate the issues.You are stuck with the existing tenant and the pre-existing lease for 10 months unless you can make his life difficult enough to convince him to leave.

If you documented pre-existing damage, that will support you.  

I would add that many syndicators only work with accredited investors with which they have a "substantive pre-existing relationship".

DSTs are probably the most expensive and cumbersome way I know of to accomplish your 1031 Exchange when it's you setting up your own (versus investing in a pre-existing one).
