General consensus from past threads about prepaid rent:1) 1 year of prepaid rent is often in violation of local laws.2) No discount for prepaid rent because you cannot legally "use" that money until earned.3) still get your background/credit ect.4) She's mouthy now it'll only get worse...NEXT.

I suggest getting a 1 month membership to legalshield (prepaid legal) for approx $15, tell them your story and see where they can help.As for the "illegal" entry, they are required by law to leave your notice inside your apartment(or they can mail).

I own a 4-plex and if it were me, I would turn over all of it, because it is not mine but the tenants money held as security for damages and prepaid rent.

@James WiseundefinedMy question is: I agreed to return their security deposit, but not the last months rent which was prepaid as liquidated damages...I was able to find quickly another tenant not even 1 week in their last month after they moved out.

@Peter Bemko I don't know about New Jersey law but taking prepaid rent removes the easiest means of eviction (non-payment of rent).

Suggest you check on state laws charging fees, any fee related to the funding of a loan is a form of points, prepaid interest and effects the APR for any disclosures that might be required and applied to usury laws. :)

Points on a loan are pre paid interest, you can't have pre paid interest on equity out of an installment contract, "installment contract" is one financed by the seller of the goods (installment loan) regardless of title conveyed, title may or may not be conveyed. :)
