In fact there are properties right around it that are used for both, a flower shop, a tattoo shop, an accounting office, an insurance office all in the same type of properties right next door. 

Grapevine, Keller, Argyle, and Flower Mound all have great school districts.

I don't think its fully "lily-white" but a common practice that goes through.I suppose if you can figure out the cost basis and the associated interest that HE has in the property, he can transfer his interest for that amount so show zero gain.
