I can see an explicit exception in CA Tax Code § 17561 that says you can not use the qualifications in Section 469(c)(7) (Real estate professional) to render that income as non-passive, but I see no callout for 1.469-1T and, as such - as a non-CPA - I do not (yet) see a reason why we cannot follow the same rules for CA that we do for our federal taxes; e.g., if the business is not a "rental" business per tax code, we count that income as non-passive and offset other income (W2, etc) similarly.Does anybody else have some guidance (or opinions) on this matter?

i just got off the phone with lindsay someone that works for them they want $34k and they offer no guarntees. thave a 78% success rate in getting people funding. that mean 22% of the prople that signed up where promised the world but were not able to raise capital. according to linday they have 700 paid members. 700x.22=154. 154 people paid them $34k and were not able to raise funds. im not an expert but they need to file a case with the attorney generals of the united states. i asked lindsay why isnt capital raising set 1 because ill pay you $34k from the money you help me raise. all of a sudden she is busy and got to hang up with me. i told her i gave you 1 objection and she gave up.i did not have a good feeling speaking with lindsay. and after the call i checked my email she sent me 2 emails. 1 minute apart from each other which tells me they will take anyone and everyone. as long as they pay $34k.

Lenders often require 30-40% down.Cash flow considerations – Since all expenses must be paid from your IRA, maintain liquidity to cover unexpected costs like repairs and vacancies.Rental properties vs. commercial deals – Residential rentals and commercial properties can both be great options, but keep in mind management complexity and income stability.Generally speaking, stay compliant – Avoid prohibited transactions, such as personally guaranteeing a loan, living in or personally managing a property, or transacting with disqualified persons (yourself, spouse, ascendants, or descendants).Diversify your portfolio – While syndications and real estate are great, consider mixing in other alternative assets like private lending, tax liens, or even notes for additional risk management.Work with the right custodian – Make sure your SDIRA custodian is well-versed in alternative investments and has experience handling syndications and non-recourse financing.If you’re looking for specific lenders who offer non-recourse loans, I’d be happy to point you in the right direction.
