My question is this.. there is a PA commonwealth lien from 2008 against the prior owner for Cigarettes' tax..

This being said, I am not an attorney or CPA, and I would suggest you speak to both of them prior to making any decisions or changes.

And of course remember that the 1031 must be in place prior to the closing of the sale of your old property and there are some unique reinvestment requirements for the investment/1031 portion.  

My real estate agent, who has a long prior career history in construction, seems to be happy with both the properties and has inspected them in detail and also been under the crawl space noting new plumbing, electrical and foundation sister-in-law beams too.As mentioned it is looking very likely the current buyer will not meet the closing deadline at which point I am next in line and have got price agreed with the back up after a few phone calls today. 

But, this might not exist prior to close.

I like being able to replay the weekly classes or hear ones from months prior to starting.

The builder will need to supply a Cost analysis, Blue print and a few other things prior to the Draw being negotiated and set up.The land that you own will act as "Equity" to offset the LTV/LTC so you are off to a good start. 

My agreement always calls for prior to close of escrow not a date specific.
