True, but if you have a civil judgement, generally they will make that E&O claim. However, no judgement, no claim.

Radhika,

Your place for a complaint is not the Washington State Real Estate Commission, but the Washington State Department of Licensing, which is over the Commission.  https://www.dol.wa.gov/professional-licenses/file-complaint .  The Commission in WA is advisory only. Complaints go through Licensing.


And yes, since your insurance is denying due to negligence, you should consult your attorney and review the PMA. That is step one to seeing if his E&O will kick in.

A suggestion, subject to your local laws:

"As time is of the essence of this Agreement, a resident’s failure to pay a security deposit or any move-in fee prior to move-in is a breach of the rental agreement."

I will second what Nathan said.  And also add that this is a lot like having friends at work that work for you.  At work, your work relationship is first and friendship is second.  You are sympathizing with her situation, which is fine, but you have a business.  Maintain your business processes and give her the required "pay or vacate/quit" notices.  Either she will get a clue, or she will then be subject to official eviction notices.  It is not personal and you should not consider it as personal.  You are being responsible to your business entity.
