Notice to Vacate

My wife and I are looking to assume control over my mother-in-law's duplex and need to remove the current tenant in order to add a bedroom and bathroom onto that side of the property.  What formal notice is required to legally request that he leave?  New Hampshire

Review the lease for the expiration date then your State's required Notice to Vacate terms. Here in Kansas, that's 30 days.

Hi Jayson, 

First, review the lease terms that are in place to understand the current agreement with the tenant. If the current lease agreement runs through June 2024, the tenant has a right to stay until then. RSA 540:2 (see below) lays out New Hampshire Law as it relates to owner/tenant rights and termination of tenancy. I appreciate the replies/knowledge sharing!  So he signed a 1 year lease back in 2014 that turned into a month-to-month after the first year elapsed.  He's been m2m since 2015 so i dont believe there will be any issues.  Update: he's been packing and boxing things up so i expect that he will stick with the timeline we gave him.
