Texas Eviction- Tenant Appeal

Texas Eviction- Tenant Appeal

I sent certified mail eviction notice to tenant on 2/8/16. They never accepted letter so after seeing this through the USPS tracking on 2/12 I taped a copy of the notice on the exterior of the front door and a copy in the mail box (I have a key). My notice stated they needed to pay past due rent or vacate no later than Saturday, 2/20/16. I filed the eviction suit on Friday, 2/19 after being told they can't move or pay on 2/18. I didn't see a reason to delay any longer. The tenant has been basically past due since Dec due to employment hours being reduced (that's their story). They were supposed to temporarily pay weekly and catch up if needed when their tax return arrived in Feb. They paid one weekly payment in Dec and Jan, and didn't catch up in full in Feb as promised. All of our communication has been by text/phone thus far until the notice mentioned above when I sent a written notice. Their failing to pay in full when their tax return came made me realize they are simply not going to catch up and led me to take legal action. The tenant contacted me by text/phone daily between 2/12 when she received my notice and 3/11 trying to negotiate things. They were offering to make weekly payments but refusing to pay the $25/day late fees owed.  Considering they never paid as promised up until now we were unable to reach an agreement. I didn't trust they would pay as promised so we went to JP court on 3/11.

The judge stated I filed my suit one day too soon and should have waited until 2/20 or later to file since my letter said they had until 2/20 to vacate or pay (even though they told me they weren't planning to do either) and that it was illegal for me to tape the notice to the front door but stated he was awarding a judgement in my favor after the tenant told them they could not be moved out by Monday should he lend them the extra day's time and they admitted they owe two months rent. He advised them they needed to be out within 5 days and they could appeal the decision. They appealed that day.

I went to the JP court to get a copy of their appeal docs and they appealed using a Pauper's affidavit inability to pay indicating their income was now equal to their rent amount and attached a Food stamp approval they recently received. When they moved in their income was 3x the rent... They have until tomorrow to pay the deposit into the court registry which the tenant informed me they plan to do. They informed me they are appealing to remain in the property that they are not planning to move.

My questions now are:

1. Do I need to hire an attorney for the County court appeal?

2. Will the county judge dismiss the case based on the errors the JP Judge mentioned above that my notice served 1-day to soon and taping it to the front door is illegal?

3. I have been reading the TX property code and it sounds like I should have given a separate written 3-day notice to vacate or a unpaid rent reminder before giving the pay or vacate eviction notice. Is this correct? Will the county judge dismiss my case if this is true?

By the time we get to the County court appeal in April at the earliest, they will owe 3 months rent and late fees. From what I read they will have to pay the deposit on tomorrow and rent each month during the appeal so hopefully that is true and the amount owed won't grow but I don't want to get to the County court and lose and have to start all over again if I should just do so now. Their lease isn't up until 7/31. This has taught me to never bend by giving a tenant extra time to pay beyond a week or so. I know better next time.

First, you did make the mistake by filling the suite one day earlier. I am not aware of separate notice. A three day notice is enough. I see no issue posting notice on the front door if you were not let in the house. I normally personally deliver my notice and ask the tenant to sign a copy. As far as income goes, we are not running a subsided business. If the tenant does not have the ability to pay, he needs to move out and seek government help if needed or move to another affordable rental. This is just my opinion.

You should not let them delay for so long to begin with. I normally maintain very good personal relationship with my tenants but I told them up front, business is business, if you don't pay, you move. If them have an eviction on their record, they will be hard to find another place later on.

Texas in general is in favor of landlords but we as landlords have to follow the legal procedures.

Take it easy, this is the way how rental business goes.

Your eviction letter needs to be a 3 Day Notice to Vacate and not give them any other options.  Many judges around here would have thrown the case out based on that.  Also we either post letter on inside of front door, hand deliver to someone over 18 or send via certified mail which are all acceptable means of delivery.

We once had a tenant file a Pauper's Affidavit and when it came time to pay the court they could not come up with the money.  They were now in default.  So we quickly filed a writ of possession and met the constable at the home a couple weeks later.  At this point I would wait to see if they come up with the money to pay the court.

    (a) During an appeal of an eviction case for nonpayment of rent, the justice court on request shall immediately issue a writ of possession, without hearing if:

    (1) A tenant fails to pay the initial rent deposit into the justice court registry within five days of the date the tenant filed a pauper’s affidavit as required by Rule 749b(1), Texas Rules of Civil Procedure, and Section 24.0053;
    (2) The justice court has provided the written notice required by Section 24.0053(a-1); and
    (3) The justice court has not yet forwarded the transcript and original papers to the county court as provided by Subsection (a-2).

The tenant has a reasonable chance to win on the appeal do to your mistake with the date.  A 3 day notice is all that is required in Texas so why did you give such a long notice ? I would point out the ample time given to the judge if this is the issue brought up in the appeal

The acceptable delivery of notice in Texas is:

    In Person

Taped to the INSIDE of the door

Certified Mail(Best to send by regular mail as well)

The tenant will need to pay rent during the appeal.  You do not need an attorney to handle the appeal

I honestly thought giving them extra time would grant them ample enough time to move or time to produce the past due rental payment. I felt they would argue a lesser period of time wouldnt allow them the time needed to find a place and I didn't want to create additional conflict in fear they would harm our property. But this situation has taught me to look into the law and make sure I follow it 100%. They made the deposit to the courts so now we will wait for our court date. If it does get thrown out due to the errors, I will at least know how to handle it moving forward.

    Hi Jen Fuller:
I Was interested to know how your appeal went ? I am in the similar situation. I made a mistake or not sure yet to be determined cuz I sent the 3 day notice only by regular mail and also sent him the email and also sent the pictures via text message. I am not sure if the regular mail is valid form of delivering 3 day notice. I gave almost 10 days before I filed tenant eviction. My tenant has also appealed the judgement which was in my favor. He or his lawyer is saying inability to pay and also dismiss the possession of property and he hired a probono lawyer & also asking for lawyer cost in the appeal. This is so frustrating cuz he is not paying rent & he also doesn’t want to move out and stay more time as long as he can.
I will appreciate any experience or experts in this for your guidance on this appeal. If I should do it myself. Also if he wins how much do I typically owe to his lawyer? Any idea how long will be the process of appeal. Looks like he will be staying there for more time without paying rent. Where as I have to pay all the bills/mortgage..!
thanks you all for your guidance and help.

Regular mail is an accepted form of delivery in Texas.  Can't imagine this will fly on appeal as it was not raised doing the eviction

Your tenant took the Pauper's affidavit route for the appeal.  Keep in mind they have to deposit one month's rent with the court within 5 days or it is dismissed.  I have had a few go the appeals route but none that have actually follow through with the rent deposit so they were dismissed

Thanks Greg for the feedback. I am hoping for the same that he doesn’t come up cuz he has a weeks time. I thought he filed the appeal only cuz he had 1 month rent money. However, what confused me is that he is also saying- INABILITY TO PAY RENT…Which is contradicting. Anyways I will keep all the papers ready to fight back… have to deal with such tenants who want to take a free ride even after giving him so much time and waiving all his late fee for several months..!

Hello, I needed some expert opinion. Whether the CARES act is still applicable..? I was defended with tenant’s attorney eviction appeal motion that due to CARES act I was supposed to give 30 days notice instead of 3 days notice for non payment of rent since my Unit is covered property & has a loan by Fannie May. I was under the impression that the CARES act got expired last year in Dec 2021 after the pandemic was over. Any suggestions will be really helpful.

    Thanks

I'm in a similar situation.  I used a lawyer and I think everything was done correctly.  After going via the JP the evication was granted.  There was an appeal and again the eviction was granted.  Now we have a THIRD appeal.   The lawyer says this level of appeal hardly ever happens and I need to go to a lawyer who is experienced in handling casrs before the appeals court.   Its dragged on for so long... Any recomendations?
