Duplex sale. Buyer won't release escrow. Broke contact. Holdover
I sold my duplex a couple of weeks ago. I had to wait until my sale closed in order to close. I asked to extend the closing date with the buyers originally, but they refused stating that they were concerned with losing their mort. and not closing in time. They agreed to allow me to live in one unit for five days so my 1031 purchase would close. We did a final walk through, nothing came up. During thae inspection two months ago, nothing came up. Now, since I moved up, they are bringing up things like the microwave door is not closing all the way (it a 20 + year old microwave), the oven range is sparking, but not lighting, a door has a ding and a table was left, which I disclosed during the walk through and they both said no problem. During the week I was staying, they withheld 10k until I moved out. I moved out the day of my closing and, again, no issues from the buyers. I walked through each room, asked if they had any issues, they both said no. I was conversing with them via text and voice each day, and they never brought anything up. I reached out again to them to see if I can work something out with them, they refused my call and never returned my call.
The attorney is trying to work a solution, but none so far. This was a NY sale. Would anyone know what options I can do in order to settle this and get my escrow back? My attorney is holding the escrow in his account. However, will not release it until the buyers agree. They've been silent for a week and refuse any contact with me.
